Welcome to RockchipMedic, a mobile rock chip repair subscription service operating in Missoula, Montana (we, us, or our). These Terms of Service (Terms) govern your subscription to and use of our services for repairing rock chips and minor windshield damage on vehicles. By subscribing, signing up, or using our services, you agree to be bound by these Terms. If you do not agree, do not subscribe or use the service.
RockchipMedic provides subscription-based mobile repair for rock chips in windshields, offered under private car subscriptions or fleet subscriptions.
1. No Refunds Policy
All subscription payments—whether for private car or fleet subscriptions—are non-refundable under any circumstances, including partial months, unused repairs, dissatisfaction, or cancellation. This applies to all fees paid.
2. Misrepresentation of Vehicle Type
Any subscriber found intentionally misrepresenting a fleet vehicle as a private vehicle (or vice versa) to obtain a lower subscription rate or unauthorized access will be subject to an immediate fine, termination of the subscription without refund, and permanent expulsion from all Rock Chip Medic services. We reserve the right to pursue additional remedies as allowed by law.
3. Subscription Renewal and Cancellation
Subscriptions automatically renew on a yearly basis (12-month term). Fleet subscriptions renew monthly, per vehicle.
To cancel or modify your service, please go to your personal dashboard and make all necessary changes.
Upon cancellation, access to services ends at the conclusion of the current paid term. No pro-rated refunds are issued for early cancellation.
4. Service Area
Our mobile repair services are only available within Missoula proper city limits (as defined by current municipal boundaries). We do not service areas outside Missoula proper, including surrounding counties or rural locations, even if within a subscription. Attempts to schedule outside this area may be declined without liability.
5. Services Provided
The subscription covers:
- Private Car - Five Rock Chip Repairs in subscription year.
- Fleet vehicles have unlimited rock chip repairs during subscription year.
Reasonable rock chip repairs (typically chips smaller than a quarter/dime, at our discretion) on covered vehicles during the active subscription term, subject to technician availability and safety/repairability. We use industry-standard resins and techniques.
Repairs do not include full windshield replacements, large or small cracks, edge damage, or damage caused by negligence, accidents, vandalism, or pre-existing conditions not disclosed. We reserve the right to refuse service if a chip is deemed unrepairable or unsafe.
6. Important Notice Regarding Windshield Repair Limitations
If the damaged area continues to spread during the repair process, Rock Chip Medic cannot be held responsible for replacing the windshield or additional damage to the windshield. While this outcome is uncommon, it is a known possibility—all chips begin spreading to some degree the moment they occur, and in some cases, they may become impossible to repair effectively.
Should spreading occur during our repair attempt, we will make every effort to address the damage at no additional charge to you. However, if the chip ultimately proves too extensive to repair successfully, we will gladly refer you to one of our trusted partner companies. They can handle a full windshield replacement, with the cost covered either by you(car owner) directly or through your(car owners) vehicle’s comprehensive insurance coverage (if applicable).
7. Eligibility and Vehicle Requirements
You must own or have permission to repair the vehicle(s) listed under your subscription. Provide accurate vehicle information (make, model, year, VIN if requested). We may inspect vehicles before or during service. Only the subscribed vehicle(s) are covered—adding vehicles requires updating the subscription and may incur additional fees.
8. Scheduling and Availability
We aim to accommodate requests expeditiously, but availability is not guaranteed. We are not liable for delays due to weather, traffic, technician illness, or other uncontrollable events.
9. Warranty
We provide a 30 day warranty on rock chip repairs performed under an active subscription: if the repaired chip re-opens or spreads under normal use (not due to new damage), we will re-repair it at no additional charge within the subscription term. This warranty is void if the vehicle is involved in an accident, undergoes unauthorized repairs, or if damage results from misuse. No other warranties, express or implied, are provided, including merchantability or fitness for a particular purpose.
10. Limitation of Liability
To the maximum extent permitted by law, Rock Chip Medic\'s total liability for any claim arising from these Terms or our services is limited to the amount you paid for the subscription in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
11. Indemnification
You agree to indemnify and hold harmless Rock Chip Medic, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or violation of any rights of a third party.
12. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or by posting a notice on our website. Continued use of our services after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of the State of Montana, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Missoula County, Montana.
